Hamid Reza NIKBAKHT FINI

Professor Dr. Hamid Reza Nikbakht Fini joined the Tribunal in July 2009. Professor Nikbakht graduated from the former National University of Iran (currently Shahid Beheshti University) with an LLB degree, and continued his academic studies at Exeter University in the U.K., receiving an LLM in 1986 and after that a Ph.D. in early 1991, both in international commercial law (sale of goods, state contracts, and arbitration).

Professor Nikbakht began his academic career in 1991 as an assistant professor in the Faculty of Law at Shahid Beheshti University in Tehran. His areas of expertise include private law, international commercial law, international arbitration, and private international law. Prof. Nikbakht is the founder of LLM and Ph.D. courses in the field of International Commercial and Investment Law in Iran.

He continued his academic career at Shahid Beheshti University as an associate professor from 1999 and was promoted to the position of the full professor in 2006.

As a full professor of law, his main field of interest and research course covers private law, in particular contract and tort, private international law and conflict of laws of the European Union (comparative conflict of laws); international jurisdiction of the courts and litigation in civil and commercial matters; international commercial arbitration; commercial law of Iran, and international trade law. He has taught these subjects mainly at the master (LLM) and doctoral (Ph.D.) programs for more than 30 years. He has been supervisor and advisor for more than 100 LLM dissertations and Ph.D. theses, majority of which have been in the field of international commercial law, predominantly in national and international arbitration.

 

Prof. Nikbakht has served as Dean of the School of Judicial Sciences of Iran (now the University of Judicial Sciences and Adminsitrative Services); Head of the Department of International Commercial Law, Faculty of Law, Shahid Beheshti University; Director of International Affairs at Shahid Beheshti University; Senior Advisor in International Affairs to the President of Shahid Beheshti University; a member of several administrative and academic committees of the university; a member of some Iranian academic associations, and member of the editorial boards of some Iranian law journals such as Iranian Yearbook of International Law, Energy Law Review, International Law Review to name a few, as well as reviewing papers for many academic journals. He has also been the director and organizer of several conferences, workshops and seminars on international arbitration and has attended several related conferences as lecturer and trainer.

He has conducted numerous research projects on different topics, including arbitration; conflict of laws; oil and gas law; nationality in public international law; legal aspects of the General Agreement on Tariffs and Trade (GATT), the World Trade Organization (WTO), and the World Intellectual Property Organization (WIPO).

Prof. Nikbakht served as Judge of the Tehran Courts of Justice for almost five years. He has extensive experience as a legal advisor in international contracts; he is an attorney at law (and member of the Iranian Bar Association); he has been an arbitrator in international arbitration cases (both institutional and ad hoc arbitrations) since 1994; arbitrator in some domestic cases; Secretary of the Iranian Association of Arbitration; a visiting scholar, lecturer and a leading member of negotiating teams for the conclusion of co-operative agreements on academic and educational matters with many universities and academic institutions in: China (Beijing & Shanghai), UK (London, Manchester, Dundee (Scotland)), United Arab Emirate (Dubai), Oman, Tajikistan, South Korea, South Africa (Johannesburg, Durban), Brazil, Senegal, India (Delhi), Netherlands, Italy, Austria, Germany, Finland.

Prof. Nikbakht has written extensively and has published or contributed to over 60 books, book chapters, and papers in peer-reviewed academic journals on the subjects of arbitration, investment, energy law, conflict of laws, international contracts and sale of goods.
